GRACE PERIOD
Some countries have a grace period during which it is possible to apply for design protection even though the design has already been published, e.g. at exhibitions or through testing. The grace period allows for filing a design application up to 12 months after disclosure of the design.
This grace period exists in all EU countries, however, other countries have differing regulations. Thus, we always recommend that an application for a design be filed prior to its disclosure. In that way, a potential loss of rights is prevented.
